Welcome to BeGenius Records. These Terms of Use (“Terms”) govern your access to and use of begeniusrecords.com and any related content, pages, or services we make available (collectively, the “Site”), operated by BeGenius Records (“BeGenius,” “we,” “us,” or “our”).
By visiting or otherwise using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site. These Terms form a binding agreement between you and BeGenius Records.
Ownership. Everything on the Site — including artist bios, music, artwork, video, photography, written content, layout, and design — is owned by BeGenius Records, its artists, or its licensors, and is protected under U.S. and international copyright, trademark, and other intellectual property laws.
Trademarks. The BeGenius Records name, logo, and any associated artist or release branding displayed on the Site are trademarks of BeGenius Records or its affiliates. You may not use them without our prior written permission.
User Content. If the Site ever allows visitors to submit comments, messages, or other material (“User Content”), you remain responsible for what you submit. By submitting User Content, you grant BeGenius Records a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting the Site.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You’re responsible for any activity that takes place under your use of the Site.
You agree not to use the Site to:
Automated Access and Data Scraping. You may not use bots, scrapers, crawlers, or any other automated tool to access, copy, or extract content or data from the Site without our prior written consent.
AI/ML Training Restriction. You may not use any content from this Site — including music, lyrics, artwork, photography, or written copy — to train, fine-tune, or otherwise develop machine learning or artificial intelligence models without our prior written authorization.
The Site and all content made available through it are provided “as is” and “as available,” without warranties of any kind, express or implied. Your use of the Site is at your own risk.
To the fullest extent permitted under Georgia law, BeGenius Records will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site. In no event will BeGenius Records’ total liability for any claim relating to the Site exceed one hundred U.S. dollars ($100.00).
You agree to indemnify and hold harmless BeGenius Records, its officers, employees, artists, and agents from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.
Governing Law. These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles.
Arbitration Agreement. Any dispute arising out of or relating to these Terms will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with arbitration to take place in Fulton County, Georgia, unless you and BeGenius Records agree otherwise.
Class Action Waiver. You and BeGenius Records agree that any dispute will be brought on an individual basis only, and not as part of a class, consolidated, or representative action.
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including a breach of these Terms.
We may update these Terms from time to time. Updates will be posted to this page with a revised effective date. Continuing to use the Site after a revision means you accept the updated Terms.
If any part of these Terms is found unenforceable by a Georgia court, the rest of the Terms will remain in full effect. These Terms make up the entire agreement between you and BeGenius Records regarding use of the Site.
